Terms of Service

1. Acceptance

By creating an account or using the ProveSite platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, do not use the Service.

2. The Service

ProveSite Inc. (“ProveSite”, “we”) provides a workforce compliance management platform for the construction industry. The Service includes worker check-in and check-out tracking, certification management, digital inductions, incident reporting, and related tools accessible via web browser at app.provesite.com.

3. Accounts and access

  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • You may not share your account credentials with others.
  • Accounts for individual workers are tied to a single organisation at a time.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable use

You agree not to:

  • Upload false, fraudulent, or fabricated certification documents.
  • Attempt to circumvent compliance checks or audit trail records.
  • Use the Service to store or transmit illegal content.
  • Attempt to gain unauthorised access to other accounts or organisation data.
  • Reverse engineer, decompile, or create derivative works from the Service.
  • Use automated scripts or bots to access the Service without prior written consent.

5. Billing and payment

Paid plans are billed monthly or annually in Canadian dollars (CAD) via Stripe. Subscription fees are non-refundable except where required by applicable law. Site-based pricing adjusts automatically as active sites are added or archived. Annual subscribers who close a site receive a prorated credit applied to their next invoice. Failure to pay will result in service suspension after a grace period.

Subcontractor accounts are always free. Billing applies only to General Contractor accounts.

6. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you submit to the Service. You grant ProveSite a limited licence to store, process, and transmit your data solely for the purpose of operating and improving the Service.

7. Compliance responsibility

ProveSite provides tools to help you document and manage workforce compliance. We do not guarantee that use of the Service ensures compliance with any specific regulation, standard, or WSIB/OSHA requirement. You are solely responsible for ensuring your organisation meets applicable legal obligations. ProveSite audit records are provided as-is and should be reviewed by qualified legal or safety counsel for regulatory submissions.

8. Intellectual property

All software, design, trademarks, and content comprising the ProveSite platform are the exclusive property of ProveSite Inc. Nothing in these Terms grants you any rights to our intellectual property other than the limited right to use the Service as described herein.

9. Limitation of liability

To the maximum extent permitted by applicable law, ProveSite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. ProveSite’s total liability for any claim arising out of these Terms shall not exceed the fees paid by you to ProveSite in the 12 months preceding the claim.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.

11. Changes

We may update these Terms from time to time. Material changes will be communicated via email at least 14 days in advance. Continued use of the Service after that date constitutes acceptance.
